Electrik Rides Terms of Service

These Terms of Service (“Terms”) govern your use of the Electrik Rides website, online store, and related services. By accessing our website, placing an order, submitting a request, or otherwise using our services, you agree to these Terms.

Throughout these Terms, “Electrik Rides,” “we,” “us,” and “our” refer to Electrik Rides. “You” and “your” refer to the customer, website visitor, purchaser, renter, repair customer, or other person using our services.

Electrik Rides is based in Riverview, Florida and serves customers throughout the Tampa Bay area and, for eligible retail products, other locations through shipping.

1. Our Services

Electrik Rides provides services that may include:

Retail sales of electric scooters, e-bikes, accessories, parts, and related products
Electric scooter and e-bike rentals
Electric scooter and e-bike diagnostics, maintenance, and repair
Local pickup and delivery services where available
Nationwide shipping for eligible retail products

Availability varies by product, service, location, inventory, vehicle compatibility, scheduling, and other factors.

Rental services and repair services may be subject to additional agreements, waivers, policies, estimates, or terms. If additional terms conflict with these general Terms, the more specific terms applicable to that transaction will control.

2. Eligibility

You must be legally capable of entering into a binding agreement to place an order or enter into a service agreement with Electrik Rides.

Certain services have additional age requirements. For example, rental customers must satisfy the age and rider requirements stated in the applicable rental agreement and waiver.

You are responsible for providing accurate, current, and complete information when placing an order or requesting service.

3. Products, Pricing & Availability

We make reasonable efforts to display accurate product descriptions, specifications, images, prices, and availability.

However:

Product specifications may change
Manufacturer information may be updated
Colors and appearance may vary by screen or production run
Inventory may change without notice
Pricing errors may occasionally occur

We reserve the right to correct errors, update information, change prices, limit quantities, or cancel an order when necessary.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

4. Orders

Submitting an order does not guarantee acceptance.

We may decline, limit, or cancel an order for reasons including:

Product unavailability
Suspected fraud
Pricing or listing errors
Payment issues
Shipping restrictions
Safety concerns
Quantity limitations
Other reasonable business considerations

If additional information is required to process your order, we may contact you before fulfillment.

5. Payment

Payment is required according to the terms presented at checkout or in the applicable service agreement.

We use third-party payment providers to process transactions. By submitting payment information, you authorize the applicable provider to process the transaction.

You are responsible for all charges associated with your order, including applicable taxes, shipping, delivery charges, deposits, service charges, and approved repair costs.

6. Taxes

Applicable sales tax and other required taxes may be collected based on the nature of the transaction, delivery location, and applicable law.

Taxes displayed at checkout or on an invoice may be calculated through Shopify or other payment and tax-processing systems.

7. Shipping

Eligible retail products may be shipped to supported destinations.

Shipping estimates are estimates only and are not guaranteed. Electrik Rides is not responsible for delays caused by carriers, severe weather, transportation disruptions, incorrect customer information, or circumstances outside our reasonable control.

Customers are responsible for providing an accurate and deliverable shipping address.

Our separate Shipping Policy provides additional information regarding shipping and fulfillment.

8. Local Delivery & Pickup

Local delivery or pickup may be available for certain purchases, rentals, and repair services.

Availability depends on factors such as:

Service type
Location
Scheduling
Order or rental eligibility
Vehicle size
Staffing
Delivery capacity

Delivery, pickup, and return arrangements must be confirmed in advance.

Electrik Rides operates from a private residential operating and service location. It is not a walk-in retail storefront. Rental pickups and repair drop-offs must be arranged in advance.

9. Returns & Refunds

Retail-product returns and refunds are governed by our Return & Refund Policy.

Certain products—including used vehicles, batteries, opened electrical components, special-order items, worn protective equipment, clearance merchandise, or final-sale products—may be excluded from standard returns.

Rental cancellations, security deposits, repair deposits, and service payments are governed by the applicable rental or repair terms rather than the retail Return & Refund Policy.

10. Manufacturer Warranties

Certain products may include a manufacturer warranty.

Manufacturer warranty coverage is provided according to the manufacturer’s terms and may differ by product, component, brand, and circumstance.

Electrik Rides does not independently expand or modify a manufacturer’s warranty unless expressly stated in writing.

We may assist customers with warranty-related questions where appropriate, but warranty eligibility and remedies may ultimately be determined by the manufacturer.

11. Rentals

Rental transactions are subject to additional terms, including the applicable:

Rental agreement
Liability waiver
Rider requirements
Age restrictions
Security-deposit requirements
Pickup and delivery terms
Damage and loss provisions
Return requirements

A rental reservation does not authorize reckless, improper, illegal, or unintended use of rental equipment.

Customers and riders are responsible for complying with applicable laws and the applicable rental agreement.

12. Repairs & Service

Repair and diagnostic services are subject to additional repair terms.

Repair work generally follows this process:

Intake and inspection
Diagnosis when required
Estimate
Customer approval
Required deposit
Approved repair work
Quality check
Pickup or return

Electrik Rides does not perform additional repair work that materially changes the approved scope or cost without customer authorization.

Repair eligibility depends on vehicle condition, compatibility, parts availability, safety, and serviceability.

We reserve the right to decline work that we reasonably determine cannot be performed safely.

13. Repair Estimates & Deposits

Repair estimates are based on the information available at the time of diagnosis or inspection.

If additional issues are discovered, we may provide a revised estimate before continuing.

For approved repairs, a 50% deposit may be required before work begins or parts are ordered.

Unless otherwise stated, the remaining balance is due when service is complete.

Where applicable, an approved diagnostic fee may be applied toward the repair job total according to the repair terms provided to the customer.

14. Customer-Supplied Parts

Electrik Rides may consider customer-supplied replacement parts on a case-by-case basis.

We reserve the right to refuse installation of any part that appears:

Incompatible
Unsafe
Damaged
Counterfeit
Incorrectly specified
Improper for the vehicle

Electrik Rides does not guarantee customer-supplied parts.

15. Safety

Electric scooters, e-bikes, lithium-ion batteries, and related equipment can present risks if used, charged, modified, transported, stored, or repaired improperly.

Customers must follow:

Manufacturer instructions
Applicable laws
Safety warnings
Charging requirements
Electrik Rides instructions
Rental or repair agreements where applicable

Do not use or charge a battery that is swollen, leaking, smoking, unusually hot, punctured, visibly damaged, or known to have experienced significant water intrusion.

16. Prohibited Uses

You may not use our website, products, rentals, or services:

For unlawful purposes
To violate applicable laws or regulations
To commit fraud or misrepresentation
To interfere with website security
To introduce malicious code
To impersonate another person
To abuse or damage rental equipment
To attempt unsafe or unauthorized modification of equipment
In any manner prohibited by an applicable agreement or waiver

We may refuse service or restrict access when reasonably necessary to protect customers, Electrik Rides, our equipment, or others.

17. Intellectual Property

The Electrik Rides name, branding, website content, graphics, photographs, designs, text, and other original materials are owned by Electrik Rides or used with permission.

You may not copy, reproduce, modify, distribute, publish, sell, or commercially exploit our proprietary content without written permission.

Third-party trademarks, product names, logos, and images remain the property of their respective owners.

18. Third-Party Services

Our website and operations may use third-party platforms and services, including providers for:

Ecommerce
Payments
Rental reservations
Repair tracking
Shipping
Email
Analytics
Customer communications

These providers may have their own terms and privacy practices.

Electrik Rides is not responsible for the independent acts, omissions, availability, policies, or systems of third-party providers except as required by law.

19. Website Availability

We do not guarantee that the website or any online feature will be available continuously or without interruption.

We may update, suspend, modify, or discontinue portions of the website or services when reasonably necessary.

20. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and general online services are provided on an “as available” basis.

Except for warranties expressly provided in writing or rights that cannot legally be excluded, Electrik Rides does not make additional guarantees regarding uninterrupted website access, error-free operation, or suitability of every product or service for every individual use.

Nothing in these Terms limits manufacturer warranties or customer rights that cannot legally be waived.

21. Limitation of Liability

To the fullest extent permitted by law, Electrik Rides will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, products, or services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Rental liability and assumption-of-risk matters are addressed separately in the applicable rental agreement and waiver.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold Electrik Rides harmless from claims, losses, liabilities, or expenses arising from your unlawful use of our website or services, violation of these Terms, or violation of the rights of another person.

23. Changes to These Terms

We may update these Terms from time to time.

The version posted on our website at the time of your transaction will generally apply to that transaction unless applicable law requires otherwise.

Material changes will be reflected by updating the effective date.

24. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

25. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable federal law or mandatory consumer-protection law provides otherwise.
